Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the DooScout website and software platform (collectively, the "Service") operated by MSGBird Systems ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

Eligibility

You must be at least 18 years old and have authority to bind yourself or the organization you represent. If you use the Service on behalf of a company or agency, you represent that you have authority to accept these Terms on its behalf.

Accounts and access

  • You are responsible for maintaining the confidentiality of login credentials.
  • You must provide accurate account information and keep it up to date.
  • You are responsible for all activity under your account, including actions by team members you authorize.

Platform integrations

DooScout connects to third-party platforms such as Meta Ads. By connecting an account, you represent that you have the right to grant us access to the connected data. Your use of third-party platforms remains subject to their terms and policies. We are not responsible for third-party platform outages, API changes, or data accuracy outside our reasonable control.

Subscription and billing

  • Paid plans are billed according to the pricing shown at signup or in your order form.
  • Unless otherwise stated, subscriptions renew automatically until canceled before the renewal date.
  • Fees are non-refundable except where required by law or explicitly stated in writing.
  • We may change pricing with reasonable notice; changes apply to subsequent billing periods.

Acceptable use

You agree not to:

  • Use the Service for unlawful, fraudulent, or harmful purposes.
  • Attempt to reverse engineer, scrape, or circumvent security or usage limits.
  • Interfere with or disrupt the Service or other users' access.
  • Misrepresent your identity or affiliation.
  • Upload malware or attempt unauthorized access to our systems.

Intellectual property

The Service, including software, branding, documentation, and visual design, is owned by Company or its licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription, subject to these Terms.

You retain ownership of your advertising data and content. You grant us a license to use that data solely to provide and improve the Service.

Recommendations disclaimer

DooScout provides analytical scores and suggested actions (such as Kill, Scale, or Watch). These are decision-support outputs, not guarantees of performance. You remain solely responsible for campaign decisions, spend, and compliance with advertising platform policies.

Confidentiality

Each party may receive non-public information from the other. Both parties agree to protect such information using reasonable care and to use it only for purposes related to the Service.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO COMPANY FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Company from claims arising out of your use of the Service, your advertising content, your violation of these Terms, or your violation of applicable law or third-party rights.

Suspension and termination

We may suspend or terminate access if you breach these Terms, fail to pay fees, or if continued provision poses security or legal risk. You may cancel according to your plan terms. Upon termination, your right to use the Service ends, though certain provisions survive.

Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, unless mandatory local consumer protection laws require otherwise. Courts in Ahmedabad, Gujarat shall have exclusive jurisdiction, subject to applicable mandatory provisions.

Changes

We may modify these Terms by posting an updated version on this page. Continued use after changes become effective constitutes acceptance of the revised Terms.
